Welcome to Surser, a Simple Survey Creation Platform designed for small businesses. By accessing or using our website (surser.com), platform (app.surser.com), or services (collectively, “Services”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, please do not use our Services. These Terms govern your use of Surser, including survey creation, hosting, and data analytics features.
1. Eligibility
You must be at least 18 years old and have the legal capacity to enter into these Terms to use our Services. By using Surser, you represent that you meet these requirements.
2. Account Registration
- To access certain features (e.g., survey creation, analytics), you must register an account with accurate and complete information.
- You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.

4. Subscription Plans
- Free Tier: Includes one survey with limited responses (e.g., 1,000–10,000) and ads, without custom branding.
- Premium Tier: Offers unlimited surveys, higher response limits (e.g., up to 1 billion), ad-free surveys, and custom branding for a monthly fee (e.g., $19.99/month, with promotional pricing).
- Payments are processed securely via Stripe. Non-payment may result in suspension of premium features.
- Refunds are not provided unless required by law.
5. Data Protection and GDPR Compliance
- Your Responsibilities: As the survey creator (“Data Controller” under GDPR), you are responsible for:
- Obtaining consent from respondents before collecting personal data.
- Ensuring survey questions comply with data protection laws.
- Informing respondents about data usage, as outlined in your privacy policy.
- Surser’s Role: Surser acts as a “Data Processor” under GDPR, hosting and processing survey responses on your behalf. We:
- Use secure servers to store data.
- Implement technical measures (e.g., encryption, cookie-based lockouts) to protect data.
- Do not share respondent data with third parties except as required for service delivery (e.g., analytics processing) or by law.
- User Rights: Respondents may have rights under GDPR (e.g., access, deletion). You must handle such requests, and Surser will assist as needed. See our Privacy Policy for details.
- Data Retention: Survey responses are retained until you delete them or your account is terminated, subject to legal requirements.
6. Intellectual Property
- Surser’s Rights: The Services, including software, design, and branding, are owned by Surser and protected by intellectual property laws. You may not copy or distribute our content without permission.
- Your Content: You retain ownership of your survey content. By using Surser, you grant us a non-exclusive, worldwide license to host, display, and process your surveys for service delivery.
7. Termination
- You may terminate your account at any time by contacting us.
- We may suspend or terminate your access for violating these Terms, non-payment, or illegal activity, with or without notice.
- Upon termination, your survey data may be deleted after a reasonable period, subject to legal obligations.
8. Limitation of Liability
- Surser provides the Services “as is.” We do not guarantee uninterrupted or error-free operation.
- To the fullest extent permitted by law, Surser is not liable for indirect, incidental, or consequential damages arising from your use of the Services.
- Our liability is limited to the amount paid by you for the Services in the preceding 12 months.
9. Indemnification
You agree to indemnify Surser against claims, losses, or damages arising from your use of the Services, including survey content or violations of these Terms or applicable laws.
10. Changes to Terms
We may update these Terms to reflect changes in our Services or legal requirements. We will notify you of material changes via email or the website. Continued use after changes constitutes acceptance.
11. Governing Law
These Terms are governed by the laws of power. Disputes will be resolved in the courts of swords.
