Surser.com (“Surser,” “we,” “us,” or “our”) provides a platform for creating and sharing micro-surveys. This Compliance Policy outlines the responsibilities of users (“you” or “survey creators”) to ensure that surveys created on our platform comply with applicable laws, regulations, and our Terms of Service. By using Surser, you agree to adhere to this policy to maintain a safe and lawful environment for all users.

1. Prohibited Survey Content

To protect respondents and comply with legal and ethical standards, you must not create surveys that:

  • Solicit Sensitive or Privileged Information: Surveys must not request personal or sensitive information, including but not limited to:
    • Social Security numbers
    • Bank account numbers or financial details
    • Credit card information
    • Passwords or authentication credentials
    • Medical or health-related information
    • Any other personally identifiable information (PII) that could be used to harm or exploit respondents
  • Facilitate Job Applications: Surser is not intended for collecting job applications or employment-related data. Surveys must not be used to solicit resumes, employment history, or other hiring-related information.
  • Solicit Payments or Financial Transactions: Surveys must not request or promote payments through apps (e.g., Cash App, Venmo, PayPal) or other financial transactions. This includes soliciting donations, fees, or any form of monetary exchange.
  • Violate Laws or Regulations: Surveys must not encourage or facilitate illegal activities, including fraud, harassment, discrimination, or violations of data protection laws (e.g., GDPR, CCPA, or other applicable privacy regulations).
  • Contain Harmful or Inappropriate Content: Surveys must not include content that is defamatory, obscene, abusive, or otherwise harmful to respondents or third parties.

2. User Responsibilities

As a survey creator, you are solely responsible for the content of your surveys and their compliance with this policy and all applicable laws. You agree to:

  • Verify Respondent Trustworthiness: Advise respondents to verify your identity and the legitimacy of your survey before participating. Surser does not verify the trustworthiness of survey creators.
  • Protect Respondent Data: Ensure that any data collected through your surveys is handled securely and in compliance with applicable data protection laws. You are responsible for obtaining any necessary consents from respondents.
  • Review Survey Content: Carefully review all questions and options to ensure they do not violate this policy or request prohibited information.

3. Surser’s Role and Limitations

Surser provides a platform for creating and distributing surveys but does not actively monitor or review the content of every survey. While we reserve the right to remove or disable surveys that violate this policy or our Terms of Service, we rely on users to report inappropriate content. You acknowledge that:

  • Surser is not responsible for the content, accuracy, or legality of surveys created by users.
  • Surser cannot guarantee that all surveys comply with this policy due to the volume of user-generated content.
  • We are developing automated tools (e.g., algorithms to detect prohibited content) to enhance compliance in the future, but these are not currently in place.

4. Respondent Guidelines

If you are a respondent completing a survey on Surser:

  • Exercise Caution: Verify the trustworthiness of the survey creator before providing any information. Do not share sensitive personal information, such as Social Security numbers, bank account details, or passwords.
  • Report Violations: If a survey requests prohibited information or appears suspicious, report it to support@surser.com.
  • Understand Data Use: Surser collects response data on behalf of survey creators, who may use it as they see fit. Review the survey creator’s privacy policy (if provided) and our Privacy Policy for details on data handling.

5. Consequences of Non-Compliance

Failure to comply with this policy may result in:

  • Removal or disabling of non-compliant surveys.
  • Suspension or termination of your Surser account.
  • Legal action, if applicable, for violations of law or harm caused to respondents or third parties.

Surser reserves the right to take any action deemed necessary to enforce this policy, in our sole discretion.

6. Compliance with Data Protection Laws

Survey creators must comply with all applicable data protection laws, including but not limited to:

  • General Data Protection Regulation (GDPR): If collecting data from respondents in the European Union, you must obtain explicit consent and provide clear information about data use.
  • California Consumer Privacy Act (CCPA): If collecting data from California residents, you must provide notice and honor opt-out requests.
  • Other local, state, or national privacy laws that apply to your surveys.

Surser is not responsible for ensuring your surveys comply with these laws. You should consult legal counsel to understand your obligations.

7. Future Enhancements

To improve platform safety, Surser plans to implement automated content moderation tools (e.g., regex-based or natural language processing algorithms) to detect and prevent prohibited content. Until these tools are in place, we rely on user compliance and reports to maintain a safe environment.
